Content Copyright, Licensing, and Data Protection Guidelines

1. Content Source 

The "AI Lesson Planner Quiz Import Feature" provided in this product is powered by the AI quiz generation system developed by the Taipei City Government’s Department of Education (referred to as “Cooc AI”). Teachers may use this feature to import generated practice quizzes into the ClassSwift platform for use in classroom activities. The usage rights of the imported content are subject to the terms of the respective ClassSwift subscription plans. 

2. Copyright Ownership 

All quizzes imported into ClassSwift through the above platform (hereinafter referred to as “Imported Quizzes”) remain the intellectual property of the original publishers and content providers. ViewSonic is authorized by law to use such quizzes within the scope of this product for display and educational use. Unless otherwise agreed in writing, teachers or users may not claim ownership of or sublicense the content to third parties. 

3. Scope of Authorization 

From the date of import, teachers are granted non-exclusive rights to use the Imported Quizzes strictly for educational purposes, including teaching, lesson preparation, and in-class practice. These materials may not be used for commercial purposes or sublicensed to any third party. 

4. Prohibited Activities 

Teachers or users may not engage in the following activities with the imported content: 

  • Use the content for any commercial purpose, including but not limited to selling, renting, reselling, or incorporating them into paid courses. 

  • Modify, reproduce, or adapt the Imported Quizzes and republish, distribute, or upload them to other platforms for profit. 

  • Publish, distribute, or upload modified, reproduced, or adapted versions of the quizzes to any platform without prior authorization, regardless of whether such actions are for profit. 

  • Re-license, transfer, or provide the content to third parties in any way that exceeds the permitted scope of educational use. 

5. Geographic and Duration Limitations 

Imported Quizzes may only be used within the teacher’s legally authorized ClassSwift account and are restricted to instructional activities within Taipei City Government’s educational system. Unless otherwise agreed in writing, this authorization has no set expiration date, provided that the use remains strictly within the educational scope defined herein. ViewSonic reserves the right to modify, revoke, or restrict this authorization at any time based on licensing terms or partner requirements, and will notify users through appropriate channels. 

6. Privacy and Personal Data Protection 

Scope of Data Collection and Processing: 
 Any personal information provided or imported by users while using this feature (e.g., teacher account details, login records, identifiable information attached to quizzes) will only be collected, processed, and used to the extent necessary for service provision and contract fulfillment. 

Purpose of Data Use: 
 The collected data will be used solely for the purposes of providing ClassSwift services, content management, technical maintenance, and legal compliance, and will not be used for any other purpose. 

Data Protection Measures: 
 ViewSonic will adopt reasonable and appropriate technical and organizational security measures in accordance with applicable data protection laws to safeguard user data from unauthorized access, disclosure, modification, or destruction. 

Data Sharing and Transfer: 
 ViewSonic will not share any personal data with third parties without user consent, unless required by law or necessary for fulfilling government partnership programs within the minimum necessary scope. 

User Rights: 
 Users may exercise their rights under applicable data protection laws to access, review, supplement, correct, delete, or request cessation of data collection or use. The application process will follow the procedures announced by ViewSonic.

7. Liability and Violation Handling 

In the event of any violation of these guidelines by a teacher or user, ViewSonic reserves the right to take the following actions: 

  • Request the immediate cessation of unauthorized use and deletion of related content or data. 

  • Pursue civil compensation based on the severity of the violation and reserve the right to take legal action. 

  • Freeze or terminate the violator’s account privileges, including but not limited to temporary suspension, feature restrictions, or permanent deactivation, without compensation. 

  • To protect user rights, ViewSonic will provide an appropriate mechanism for appeal and reinstatement. Users who object to account-related penalties may file an appeal within seven days of notification, stating their reasons and supporting evidence. ViewSonic will review each case individually and respond within a reasonable time frame. 

8. Amendments and Termination of Authorization 

If there are changes to licensing agreements, termination of partnerships, legal requirements, or other circumstances, ViewSonic may adjust or revoke authorization for specific Imported Quizzes. Teachers or users will be notified accordingly and must cease use or delete the relevant content as instructed. No compensation or indemnity may be claimed under such circumstances.
